General Terms
Introduction
Welcome to dexsport.io, a website-hosted user interface provided by Dexsport. In these General Terms, dexsport.io and all related access points are collectively referred to as the “Interface”. This Interface provides users with a community-based environment to access Dexsport data protocols, supporting software, virtual currency interaction functions, and liquidity-related features.
These General Terms, together with the Privacy Policy incorporated by reference, constitute a binding legal agreement between the user and Dexsport. Accessing, browsing, connecting to, or otherwise using the Interface means that the user has read, understood, and accepted these Terms. If the Interface is used on behalf of a company or other legal entity, the person using it confirms that they have valid authority to bind that entity.
Any party that does not accept these Terms is prohibited from accessing or using the Interface. Use of the Interface also constitutes agreement to resolve certain disputes through binding individual arbitration rather than court proceedings, and to waive class actions or other representative legal actions.
Eligibility and Restricted Access
Use of the Dexsport platform Interface is permitted only to users who are at least eighteen years old, possess legal capacity, and can enter into a binding agreement with Dexsport. All use must comply with applicable laws, regulations, sanctions, and restrictive measures.
Access is prohibited for individuals or entities connected with the United States, including residents, citizens, incorporated entities, or entities with a registered office or principal place of business there. Access is also prohibited for users from restricted jurisdictions, including Myanmar, Ivory Coast, Burundi, Cuba, Crimea and Sevastopol, Belarus, Antigua and Barbuda, Algeria, Bangladesh, Bolivia, the Democratic Republic of the Congo, Iran, Iraq, Libya, Mali, Liberia, Nicaragua, North Korea, Nepal, Somalia, Morocco, Sudan, Syria, Yemen, Venezuela, Zimbabwe, Ecuador, and any other jurisdiction subject to sanctions enforced by the United States, the United Kingdom, or the European Union.
Users must not use VPNs, proxies, address-masking tools, or similar methods to bypass location restrictions. Dexsport may limit, suspend, or deny access to the Interface for any person, entity, area, or jurisdiction at any time.
Compliance and User Responsibility
Dexsport expressly states that users are solely responsible for complying with all applicable laws and regulations when accessing or using the Interface. Dexsport has no obligation to inform users about legal liabilities, tax payments, required filings, reporting duties, or regulatory restrictions that may apply to them.
Use of the Interface is prohibited in any jurisdiction where such use would be unlawful or would impose registration, licensing, or other legal obligations on Dexsport that it has not accepted. Users must also verify that the source of any virtual currency or crypto asset used in connection with Dexsport is lawful. Dexsport reserves the right to block or deny access if such assets are found to derive from illegal sources, including drug trade, dark web activity, sanctions evasion, fraud, theft, or other unlawful conduct.
Nature of the Interface and Blockchain Risk
The Interface of the Dexsport platform provides access to decentralized networks, virtual currency systems, blockchain tools, and related supporting software. These systems carry inherent risks, including cryptographic risks, network congestion, virtual currency volatility, protocol failures, smart contract vulnerabilities, transaction delays, and changes in on-chain fees.
Dexsport has no control over core blockchain elements and cannot cancel, roll back, modify, confirm, or guarantee any on-chain interaction initiated by the user.
All information available through the Interface is for reference only. It does not constitute an offer, solicitation, investment, financial, tax, legal, or other professional advice. Users should consult independent qualified specialists before making decisions connected with the Interface.
User Representations
All users accessing the Dexsport Interface confirm that they understand the risks associated with blockchain-based digital assets and decentralized technologies. Users bear full responsibility for all decisions, transactions, and actions carried out through or in connection with the Interface.
Digital asset markets may experience significant fluctuations caused by factors such as adoption, speculation, technology, security, liquidity, regulation, and other conditions. The speed and cost of on-chain transactions may also change abruptly at any time. Dexsport assumes no liability for losses connected with these variables.
Users must independently safeguard their private keys, wallet credentials, passwords, devices, and virtual currency. Dexsport shall not be responsible for lost, stolen, mishandled, compromised, or unrecoverable private keys or assets.
Prohibited Conduct
The Dexsport platform states that users of the Interface must comply with the prohibitions set out in these Terms. Users may not use the Interface for unlawful, abusive, fraudulent, manipulative, or security-compromising activity.
Prohibited conduct includes general violations such as breaching these Terms or applicable law, infringing intellectual property or privacy rights, disrupting systems or networks, deploying harmful code, reverse engineering the Interface, publishing false information, spoofing, wash trading, market manipulation, fraud, or similar misconduct.
Users are also prohibited from Web3-specific violations, including stealing or attempting to obtain private keys or wallet credentials, laundering crypto assets, using assets derived from criminal proceeds, dark web activity, drug trade, fraud, or other illegal sources, and bypassing regional restrictions through VPNs, proxies, IP masking, or similar tools. Dexsport may restrict, suspend, or terminate access if a user violates these Terms, applicable law, or platform security requirements.
Proprietary Rights and User Materials
Dexsport holds ownership and control over intellectual property rights related to the Interface and its content, including software, text, designs, images, trademarks, service marks, copyrights, patents, and other protected materials, except where certain elements form part of open-source protocol software. Accessing or using the Interface does not give the user any ownership, intellectual property rights, or other proprietary rights in such materials.
Without Dexsport’s express authorization, users may not copy, modify, adapt, license, sell, publish, distribute, or permit any third party to access or use the Interface or its content for unauthorized purposes.
Users retain ownership of the information and materials they submit through the Interface. However, by submitting such materials, the user grants Dexsport a worldwide, royalty-free, irrevocable license to use, copy, distribute, publish, transmit, and process them in accordance with applicable laws. Dexsport may also use feedback, bug reports, comments, suggestions, and similar materials without compensation or confidentiality obligations.
Third-Party Resources and Privacy
The Interface may contain links or references to third-party websites, materials, products, services, promotions, or other resources that are not owned or controlled by Dexsport. Dexsport does not endorse these resources and assumes no responsibility or warranty liability for them. Users who access third-party resources do so entirely at their own risk.
Use of the Interface also constitutes acknowledgment of Dexsport’s Privacy Policy and agreement that personal information may be collected, used, stored, disclosed, and otherwise processed in accordance with that Privacy Policy and applicable regulations.
Disclaimers and No Warranties
Dexsport provides the Interface on an “as is” and “as available” basis. Dexsport disclaims all warranties of any category, whether express, implied, statutory, or otherwise, regarding the Interface, the Protocol, any code, data, or related information.
Dexsport does not guarantee the accuracy, completeness, reliability, current status, security, uninterrupted operation, error-free performance, suitability, absence of defects, or absence of harmful components of the Interface or associated data. No information or statement published through the Interface creates any warranty, and users assume full responsibility for all risks arising from their use of the Interface.
Limitation of Liability and Indemnity
To the fullest extent permitted by law, Dexsport and its related parties shall not be liable for indirect, incidental, consequential, punitive, exemplary, or similar damages, including loss of profits, goodwill, data, use, private keys, virtual currency, or other intangible property.
This limitation applies to losses arising from hacking, unauthorized access, service interruptions, technical failures, errors, bugs, viruses, third-party conduct, or use of information obtained through the Interface.
Users agree to defend, indemnify, and hold harmless Dexsport and its related parties from claims, losses, liabilities, costs, and expenses arising from their use of the Interface, violation of these Terms, unlawful conduct, infringement of third-party rights, or assisted use by another party.
Dispute Resolution
All disputes between the user and Dexsport relating to these Terms or the Interface are private disputes between the two parties. Users may bring resolution proceedings only in an individual capacity and may not seek class arbitration, file a class action, or pursue any representative legal proceeding.
Before starting formal proceedings, the user must send a notice to [email protected] that includes the user’s name, mailing address, email address, description of the dispute, and requested action. If the dispute remains unresolved after a thirty day negotiation period, either party may initiate arbitration where permitted under these Terms.
All claims must be filed within one year from the date the dispute arises. If this deadline is missed, the right to file the claim will be permanently barred.
Governing Law and Arbitration
These Terms are governed by the laws of the Seychelles, with all conflict of laws principles excluded. Any unresolved dispute related to these Terms or the Interface must be resolved through binding arbitration conducted in English in London, United Kingdom, under the rules of the London Court of International Arbitration.
The arbitrator may not consolidate claims from multiple parties or preside over class, representative, or multi-party proceedings. The Interface is deemed to be based in the Seychelles, and access to the Interface from any other region does not establish jurisdiction outside the Seychelles.
Changes to These Terms
Dexsport reserves the right to publish updated versions of these Terms at any time and modify their content. Any changes become effective when the user first accesses or uses the Interface after the updated version is published. Continued use of the Interface is deemed acceptance of the revised Terms.
If the user does not agree to the revisions, the user’s sole remedy is to stop using the Interface. Any rights and obligations that are required to remain in effect after termination of use shall remain valid.
Entire Agreement and Contact
These Terms and all incorporated supporting materials constitute the entire agreement between the user and Dexsport regarding use of the Interface.
